These Terms of Service outline the agreement between you, the Client, and me, the Artist, regarding your use of EagerSprout Services and Pixel Artwork. By accessing or using my services, you acknowledge that you have read, understood, and agreed to these terms.OWNERSHIP AND USE OF ARTWORK
a. All Artwork created by the Artist remains the sole property of the Artist, including all intellectual property rights, unless otherwise agreed in writing.
b. The Client receives only the license or service rights specifically purchased. Any use outside those rights requires prior written permission.
c. Personal Use License is available for personal and non-commercial use only.
d. Commercial Use License is available for commercial use on a non-exclusive basis.
e. Commercial Exclusive License is available for exclusive commercial rights under agreed terms.
f. Hourly Contract or Monthly Contract services are available under separate written agreements.COPYRIGHT AND ATTRIBUTION
a. The Artist retains the right to showcase and promote the Artwork in portfolio, website, or social media, unless otherwise agreed between both parties.
b. The Client agrees to provide appropriate credit to the Artist whenever the Artwork is used publiclyCOMMISSION AND PAYMENT PROCESS
a. The Artist may request references such as images, videos, or sketches to better understand the project.
b. The Artist only creates SFW (Safe For Work) Artwork.
c. The Artist will provide an estimate of pricing, scope, and timeline before work begins.
d. Full or half upfront payment may be required before starting.
e. Sketches, updates, and agreed revisions may be provided during the process when applicable.
f. Payments are accepted only through PayPal or Ko-fi in USD currency.REFUNDS
a. If the Client cancels after work has started, payments already made are non-refundable unless otherwise agreed.
b. If the Artist is unable to complete the project as agreed, a fair partial or full refund may be issued depending on progress made.DISCLAIMER OF WARRANTY
a. The Artist provides Artwork and services without warranty or guarantee of any kind.LIMITATIONS ON USE
a. The Client may not use the Artwork for illegal, harmful, hateful, or offensive purposes.
b. The Client may not claim the Artwork as their own or misrepresent authorship.
c. The Client may not use the Artwork in any way that violates laws or third-party rights.LIMITATION OF LIABILITY
a. The Artist is not liable for indirect, incidental, or consequential damages related to use of the Artwork or services.
b. Liability, if any, is limited to the amount paid by the Client for the specific service or Artwork.By purchasing EagerSprout Services you agree to fulfill these Terms of Service. If you have any questions, please contact me by email or DMs. Thank you for your time!
Personal Use License: Non-exclusive license for personal and non-commercial use only. No resale, redistribution, or commercial monetization allowed.Commercial Use License: Non-exclusive license for commercial use. The Artist may continue licensing or using the Artwork elsewhere unless otherwise agreed.Commercial Exclusive License: Exclusive commercial rights for the agreed scope, duration, and usage terms. The Artist will not license the same Artwork commercially to others during that period.Commission Service: One-time custom Artwork created for the Client based on the agreed scope, style, revisions, timeline, and purchased license.Hourly / Monthly Contract: Ongoing work billed by hour or monthly rate. Scope, workload, deadlines, rights usage, and payment terms must be agreed in advance.
